Attendees learn the basics of student loans. Topics include: differences between Federal and Private loans, the different Federal repayment plans, administrative discharge of Federal loans, strategies to deal with default loans, defending Federal and Private student loan lawsuits, and more.
Affirmative Student Loan Litigation
Attorneys learn how to identify and bring actions against debt collectors, and where able, against lenders, servicers, and guarantors. The Fair Debt Collection Practices Act (FDCPA) is discussed in detail, as this is a federal law that most protects consumers from harassing and deceptive debt collection conduct.
Bankruptcy
Those that complete this course learn how to successfully discharge a student loan in bankruptcy, the differences in difficulty between discharging a Federal and a Private loan, and alternative ways that bankruptcy can help even when discharge is not likely to be granted.
